Steeplechase Obstacle Course & Trail Run and other Team Activities at The Stables Fitness & Wellbeing

WAIVER, RELEASE OF LIABILITY, COVENANT NOT TO SUE & IMAGE RELEASE

DEFINITIONS - “Organisers” means The Stables Fitness & Wellbeing Ltd of Coolnastud, Gorey, Co.Wexford Y25 DW74. “Events” means The Steeplechase Obstacle Course & Trail Run at The Stables Fitness & Wellbeing. “Participant” means the named person taking part in the event as detailed below. “Terms and Conditions” means the terms and conditions set out below.

I understand that participating in these events is potentially hazardous, and that I should not enter and participate unless I am medically able and physically capable of taking part.

The risk of serious injury and/or death from the activities involved as a participant is significant and may include, without limitation, the following: (i) drowning, (ii) near drowning, (iii) sprains, (iv) strains, (v) fractures, (vi) heat and cold injuries, including burns, heat related illness and/or hypothermia, (vii) repetitive strain injury, (viii) injuries involving the acts or omissions of other event participants or vehicles, (ix) animal bites or stings, (x) contact with poisonous plants (xi) falling from heights, (xii) heart attack, (xiii) diseases from exposure to faecal contaminated water or slurry, (xiv) permanent paralysis and/or (xv) death.

I assume full and complete responsibility for any injury, accident, or death which may occur while I am travelling to or from The Stables Fitness & Wellbeing, during the Events or any of the activities that I par-take in when here, or while I am on the premises of The Stables Fitness & Wellbeing.

I understand that I enter this event at my own risk and that neither Organisers of the Event, any member of Event or The Stables Fitness & Wellbeing, any of our instructors or stewards will be held responsible for any accident suffered or injury sustained by myself from any cause whatsoever or for any property lost, mislaid or stolen on The Fitness & Wellbeing premises.

To the fullest extent permissible by applicable law, “I “, on behalf of myself and/or my respective heirs, assigns, spouses, partners, personal representatives, next of kin, forever WAIVE, RELEASE, DISCHARGE and COVENENT NOT TO SUE THE STABLES FITNESS & WELLBEING LTD, the venue owner, and their respective owners, officers, directors, employees, contractors, representatives, agents and affiliates, and as applicable any in direct parent or subsidiary, predecessor, successor, heir, assign, media partners, associated charity, sponsor or medical providers of any of the foregoing, with prospect TO ANY LAWSUITS, CLAIMS, OR LOSS AND ALL INJURY, DISABILITY, DEATH, AND/OR LOSS OR DAMAGE TO PERSON OR PROPERTY, IN CONNECTION WITH MY PARTICIPATION IN THE EVENT, WHETHER ARISING FROM THE NEGLIGENCE OR WILFUL CONDUCT OF THE STABLES FITNESS & WELLBEING LTD.

Furthermore, I irrevocably grant unlimited permission to any of the foregoing to use photographs, films or recordings of the event for any legitimate purpose. Such permission shall include granting the unlimited and irrevocable rights to The Stables Fitness & Wellbeing without compensations of any kind to the Participant, to use, reproduce or broadcast the photographs/videos in connection with the event.

The Organisers reserve the right, in their sole determination to postpone, cancel of modify the Event due to weather conditions or other factors beyond the control of the Organisers and I understand that my fee paid to take part in this event is non-refundable.

In consideration and in return for being allowed to participate in the Events, the Participant releases and agrees not to sue any of the Organisers, from all present and future claims regarding the Participants participation in events organised by the Organisers, including the Event, by the Participant and his/her heirs, assigns, spouses, partners, personal representatives and/or next of kin.

If any of the provisions of this Waiver, Release of Liability, Covenant Not to Sue & Image Release (‘Waiver”) shall be deemed by a court of competent jurisdiction invalid or unenforceable in any respect, then, to the fullest extent permitted by applicable law, all other provisions hereof shall remain in full force and effect.

I confirm that I have been given a full safety briefing prior to the start of the event and I agree to all the terms and conditions stated above.

I HAVE READ AND FULLY UNDERSTAND THIS WAIVER. I UNDERSRAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOULNTARILY.
